DJ Bell and his partner, Dan Fair were severely beaten July 4, 2008. Their neighbors were charged with the beatings after Bell said they were attacked when their neighbors claimed they kidnapped two children from their home. Bell was initially charged with kidnapping, but was later acquitted in court. But the twist came afterward when Bell says a cat and mouse game began.

Salt Lake District Attorney, Lohra Miller was accused of reneging on her promise saying the seven defendants accused of beating the two men would get immunity if they took the stand during the trial. They say the evidence was based on a letter from prosecutors. But instead they are now charged with felony assault.

In court Thursday, Miller took the stand once again defending the letter saying Felony charges were not filed at the time and that new information came to light in the case. The defense said the case is riddled with conflict of interest and they want the DA thrown off the case and the charges dropped. Yet no decision was made.

Another hearing is slated to be held Sept. 20.
