Conviction of man who flashed his diaper to young girls overturned

SALT LAKE CITY – The Utah Supreme Court overturned the conviction of a man who allegedly approached young girls while wearing a diaper and then adjusted his clothes to display the diaper.

Barton Bagnes, 36, has been in the Utah State Prison since 2010, which is when he was convicted on second-degree felony sexual exploitation of a minor and third-degree felony lewdness charges.

The conviction was overturned Friday, as the court ruled that, while his behavior may have been strange or socially unacceptable, his actions did not reach the level of criminal lewdness or sexual exploitation.
