Officials: Shooting in brawl between brothers-in-law that left one dead is justified

HYRUM, Utah – The Cache County Attorney’s Office has ruled a deadly shooting between two brothers-in-law was justified.

Back on Oct. 14, deputies were called to a shooting at a home near 84 N. and 600 E. where a person was reported dead.

Deputies said 40-year-old Provo resident Aaron Smith told them he fired his gun in the house and killed 37-year-old Robert J. Van Hermert.

Officials said the relatives were arguing over property issues when Van Hermert pulled a gun which led Smith to brandish his own weapon and fire in self-defense.

The Cache County Attorney’s Office said it reviewed the shooting and found Smith’s used of deadly force was justified under state law.
