DENVER – A federal appeals court will hear a lawsuit challenging Alta Ski Area’s ban on snowboarding Tuesday.
The 10th Circuit Court of Appeals in Denver has agreed to hear the arguments.
A group calling itself “Wasatch Equality” is suing Alta and the U.S. Forest Service, claiming Alta’s ban on snowboarders violates their 14th Amendment rights to equal protection.
The group is trying to claim a Constitutional right to snowboard.
Wasatch Equality says it is a recognized class that should be protected.
The 14th Amendment has been used in cases of race, gender religion and most recently, same-sex marriage.
