SALT LAKE CITY — A lawsuit filed by a Utah Internet Service provider that accused a Florida company of spamming more than 100,000 email addresses has been quietly settled.
A notice in federal court indicated XMission’s lawsuit against Clickbooth had been recently settled, with both sides bearing their own attorney’s fees. XMission originally sued, seeking more than $60 million in damages and accusing Clickbooth of violating the federal CAN-SPAM act and sending unwanted emails to its customers.
Terms of the settlement were confidential, lawyers for XMission and Clickbooth said.
“There was no finding of wrongdoing,” Richard Newman, an attorney for Clickbooth, said in a statement to FOX 13. “The parties mutually reached an agreement.”
